General Terms and Conditions of Business and Sale for the Purchase or Reservation of Admission Tickets via the Online Portal www.salzbergwerk.de

The provider is Südwestdeutsche Salzwerke AG ("SWS AG"), Berchtesgaden Salt Mine, Bergwerkstraße 83, D-83471 Berchtesgaden. Further information can be found in the legal notice.

For reasons of readability, these General Terms and Conditions do not use gender-specific language. However, the term "customer" applies equally to all genders and does not imply any judgement or discrimination.

Section 1 Purchase of admission tickets

Tickets and reservations for the following admissions can be purchased at www.salzbergwerk.de:

(1)   Tickets for a visit to the Berchtesgaden Salt Mine.

(2)   Combination tickets for a visit to the Berchtesgaden Salt Mine and the Old Salt Works in Bad Reichenhall (for special provisions, see Section 3).

(3)   Tickets for Dinner in the Berchtesgaden Salt Mine (for special provisions, see Section 10).

 Section 2 Purchase and reservation procedure for visiting the salt mine

On the website www.salzbergwerk.de, admission tickets and reservations for visiting the Berchtesgaden Salt Mine can be purchased as follows:

(1)   Orders with login credentials (after receipt of a password and login name) for tour operators: reservation only; payment before entering the visitor mine at the ticket office or, where applicable, by invoice.

(2)   Orders with login credentials (after receipt of a password and login name) for partners: purchase on account, invoiced monthly. Available for groups of up to 19 people. The partner provides the purchased online tickets to its customers.

(3)   Orders without login credentials:

a)    Individual/group bookings of 1 to 19 tickets: online booking and payment by credit card or PayPal; the admission ticket(s) are provided as online tickets for self-printing or display on a mobile device.

b)    Orders of 20 tickets or more: online reservation; the admission ticket(s) are issued and paid for on site at the visitor mine ticket office or, where applicable, by invoice.

c)    Children up to the age of three are admitted free of charge. However, a ticket must also be obtained for them. If the child’s age is entered correctly, no charge will be made for the ticket. Proof of age may be checked during the visit (identification document). If entitlement to a free ticket cannot be demonstrated during the visit, the regular ticket price must be paid.

In addition, the General Terms and Conditions and Rules of Conduct for the Visitor Mine apply to visits to the visitor mine. Explanations during the guided tour are generally provided in German. However, free audio guides are available in English, French, Dutch, Italian, Spanish, Russian, Slovenian, Polish, Czech, Hungarian, Japanese, Chinese, Korean, Arabic, Hebrew and Thai.

 Section 3 Purchase and reservation of a "combination ticket"

Combination tickets for the following admissions may be purchased during specified offer periods, but not during the partners’ maintenance periods or closure periods:

(1)   Berchtesgaden Salt Mine + Old Salt Works Bad Reichenhall – for details, see Section 4

(2)   Berchtesgaden Salt Mine + Eagle’s Nest – for details, see Section 5

(3)   Berchtesgaden Salt Mine + Lake Königssee – for details, see Section 6

(4)   Berchtesgaden Salt Mine + Jennerbahn – for details, see Section 7

(5)   Berchtesgaden Salt Mine + Berchtesgaden Advent – for details, see Section 8.

(6)   Berchtesgaden Salt Mine + Berchtesgaden Advent (Salz.Berg.Advent) – for details, see Section 9.

Section 4 Combination ticket: Berchtesgaden Salt Mine + Old Salt Works Bad Reichenhall

(1)   Combination tickets for the Berchtesgaden Salt Mine + Old Salt Works Bad Reichenhall can be purchased online for 1 to 19 people and reserved online for 20 people or more, in the same way as online tickets for the salt mine.

(2)   For combination tickets with the Old Salt Works, the maximum group size per guided tour is 50 people in the salt mine and 40 people in the Old Salt Works.

(3)   When booking via www.salzbergwerk.de, the customer selects a fixed date and time for both the Berchtesgaden Salt Mine and the Old Salt Works Bad Reichenhall. The customer then receives a PDF containing two tickets, one page for the Berchtesgaden Salt Mine and one page for the Old Salt Works Bad Reichenhall.

(4)   The ticket for the Berchtesgaden Salt Mine is validated directly at the turnstile at the salt mine on the booked date.

(5)   The ticket for the Old Salt Works Bad Reichenhall is validated directly at the ticket office of the Old Salt Works Bad Reichenhall on the booked date.

Section 5 Berchtesgaden Salt Mine + Eagle’s Nest

(1)   Combination tickets for the Berchtesgaden Salt Mine + Eagle’s Nest can be reserved online for groups of 20 people or more, for adults and children.

(2)   When making a group reservation via www.salzbergwerk.de, the customer selects a fixed date and time for the Berchtesgaden Salt Mine and specifies a preferred date and time for the Eagle’s Nest. The customer receives a PDF containing a reservation for the Berchtesgaden Salt Mine and the Eagle’s Nest.

(3)   The reservation becomes valid as soon as the customer receives a reservation confirmation from the Eagle’s Nest.

(4)   The combination ticket is valid only on the day of purchase and the following two days. It may be redeemed only within this period.

 Section 6 Combination ticket: Berchtesgaden Salt Mine + Lake Königssee boat trip

(1)   Combination tickets for the Berchtesgaden Salt Mine + Lake Königssee boat trip can be reserved online for groups of 20 people or more, in the same way as online tickets for the salt mine. The combination ticket is valid only on the day of purchase and may be redeemed only on that day.

(2)   When booking via www.salzbergwerk.de, the customer selects a fixed date and time for the Berchtesgaden Salt Mine and specifies a preferred time for the boat trip on Lake Königssee. The customer receives a PDF containing a reservation for the Berchtesgaden Salt Mine and Lake Königssee.

(3)   The reservation becomes valid as soon as the customer receives a reservation confirmation from Restaurant Bergschänke and Königssee Shipping.

(4)   The customer presents the reservation confirmation at the salt mine ticket office. After payment on site, the valid ticket is issued. The ticket for the combination, serving as the voucher for Lake Königssee, is validated by the cashier within the combination ticket’s validity period, namely the day of purchase, and the customer receives the valid admission ticket in exchange.

Section 7 Combination ticket: Berchtesgaden Salt Mine + Jennerbahn

(1)   Combination tickets for the Berchtesgaden Salt Mine + Jennerbahn can be reserved online for groups of 20 people or more, in the same way as online tickets for the salt mine. They are available for adults and children. The ticket is valid only on the day of purchase and the following two days. It may be redeemed only within this period in accordance with paragraph (4).

(2)   The ticket for the combination, serving as the voucher for the Jennerbahn, is validated by the Jennerbahn cashier within the combination ticket’s validity period, and the customer receives the valid admission ticket in exchange.

(3)   When making a group reservation via www.salzbergwerk.de, the customer selects a fixed date and time for the Berchtesgaden Salt Mine and specifies a preferred date and time for the Jennerbahn. The customer receives a PDF containing one ticket and one voucher for the Berchtesgaden Salt Mine and the Jennerbahn.

(4)   The reservation becomes valid as soon as the customer receives a reservation confirmation from the Jennerbahn.

Section 8 Combination ticket: Berchtesgaden Salt Mine + Berchtesgaden Advent

(1)   Combination tickets for the Berchtesgaden Salt Mine + Berchtesgaden Advent can be reserved online for groups of 20 people or more, in the same way as online tickets for the salt mine, and are available for adults only. The combination ticket is valid only during Advent and only within the offer period. It may be redeemed only within this period.

(2)   When booking via www.salzbergwerk.de, the customer selects a fixed date and time for the Berchtesgaden Salt Mine but does not select a date or time for Berchtesgaden Advent. The customer receives a PDF containing one ticket for the Berchtesgaden Salt Mine.

(3)   The customer presents the reservation confirmation at the salt mine ticket office. After payment on site, the valid ticket is issued and vouchers for a filled mug are handed out.

(4)   Following the salt mine tour, the customer receives the meal included in the price at Restaurant Bergschänke opposite the salt mine. The customer must present the salt mine ticket at the restaurant.

Section 9 Salz.Berg.Advent combination ticket (Berchtesgaden Salt Mine + Berchtesgaden Advent)

(1)   Salz.Berg.Advent combination tickets can be reserved online for groups of 20 people or more, in the same way as online tickets for the salt mine, and are available for adults only. The combination ticket is valid only during Advent and only within the offer period. It may be redeemed only within this period.

(2)   When booking via www.salzbergwerk.de, the customer selects a fixed date and time for the Berchtesgaden Salt Mine but does not select a date or time for Berchtesgaden Advent.

(3)   The customer presents the reservation confirmation at the salt mine ticket office. After payment on site, the valid ticket is issued and vouchers for a filled mug are handed out.

Section 10 Special provisions for purchasing the "Dinner in the Salt Mine" ticket

In deviation from Section 2, a specific date must be selected when purchasing online tickets for Dinner in the Salt Mine.

Section 11 Special provisions for purchasing the "Staade Zeit im Berg" ticket

In deviation from Section 2, the following applies to online tickets for Staade Zeit im Berg, including a reading in the healing gallery:

(1)   The purchase is made as described in Section 2, except that an online reservation for 50 people or more is possible only for a specific date.

(2)   A specific date must also be selected when purchasing online tickets for up to 19 people. The customer chooses between a reclining place and a seat.

Section 12 Discounts and proof of eligibility

Discounted tickets are available to persons holding discount vouchers shown in the salt mine’s online ticket shop. These tickets can also be booked online. Discount vouchers do not need to be scanned. However, entitlement to the discount will be checked during the visit. If the customer cannot demonstrate their entitlement during the visit, the ticket does not entitle the holder to admission.

Section 13 Conclusion of the contract

(1)   For offers that can be booked online, the contract is concluded by clicking the "Submit order" and "Buy now" buttons.

(2)   After ordering and/or reserving admission tickets for up to 19 visitors at www.salzbergwerk.de, the customer proceeds to payment. The payment method is selected through the service provider Unzer. Once payment has been completed, the customer immediately receives an email containing the order details as confirmation.

Section 14 Online ticket for self-printing/display on mobile devices

(1)   Online tickets for self-printing or display on a mobile device are available when payment is made by credit card or PayPal. For 1 to 19 visitors, use of an online ticket is mandatory.

(2)   Online tickets for visiting the salt mine can be booked at any time up to no later than 30 minutes before the guided tour begins. After successful booking, the ticket is sent by email as a PDF file and can be displayed electronically or printed on DIN A4 paper. The ticket shows the admission ticket or tickets, including for several people where applicable.

(3)   The online ticket is transferable.

(4)   In the online ticketing process, the various booking details are encoded in a Data Matrix code. In the event of misuse, for example an attempt to use an online ticket more than once without authorisation, no valid admission ticket exists. In this case, the admission price will be charged retrospectively. In addition, the misuse will be reported to the police.

Section 15 Special provisions for group bookings

(2) Unless otherwise agreed, the price payable for a group booking must be paid no later than immediately before the service is used, at the admission ticket office in cash or by debit or credit card. On the basis of a separate agreement, Südwestdeutsche Salzwerke AG (SWS AG) offers selected contractual partners the option of settling accounts using vouchers and monthly statements. Invoices issued by SWS AG are due for payment without deduction upon receipt. The contractual partner will be in default if payment is not made within 30 days of the invoice date.

(3) The group size per guided tour is between 50 and 55 people, or a maximum of 40 people at the Old Salt Works. Group allocation is at the sole discretion of SWS AG. If the contractual partner’s booked group does not reach this number, the group may be supplemented with other guests. If this is not desired, a separate exclusive guided tour can be booked subject to special conditions.

(4) In the case of group reservations without online payment, SWS AG is entitled to withdraw from the contract if facts give rise to justified concern that the contractual partner will be unable to pay for the booked service. This applies in particular if an application has been filed to open insolvency proceedings against the contractual partner’s assets.

Section 16 Product vouchers

(1) Vouchers that can be redeemed for a visit to the Berchtesgaden Salt Mine or the combinations listed above can also be purchased through the online ticket shop. The customer then receives a promotional code by email, which can be entered in the online ticket shop during the booking process.

(2) The vouchers are valid for three years.

(3) Consumers have a statutory right of withdrawal for vouchers; see below.

Section 17 Verification and complaints

(1)   Immediately upon receipt of the admission ticket or the order confirmation sent by email, the customer must check that the number of visitors, date and time are correct. The information on the invoice or receipt must also be checked.

(2)   Complaints concerning incorrect admission tickets or invoices must be submitted immediately, meaning no later than two working days after receipt of the order confirmation. Complaints must be made in writing by email to info@salzbergwerk.de, by fax to +49 (0)8652-6002-60, or by letter to Südwestdeutsche Salzwerke AG, Bergwerkstr. 83.

Section 18 Cancellation

(1)   The online purchase of tickets for 1 to 19 people is always binding. Purchased tickets cannot be cancelled or exchanged.

(2)   A group reservation may be cancelled free of charge up to five days before the visit. Cancellations must be submitted by email to info@salzbergwerk.de. If the cancellation is made less than five days before the booked date, a cancellation fee of 20% of the booking amount will be charged.

(3) Orders placed by partners using login credentials in accordance with Section 2(2) may be cancelled free of charge up to five days before the visit. Cancellations must be submitted by email to info@salzbergwerk.de. If the cancellation is made less than five days before the booked date, notification must also be given by telephone at +49 (0)8652-6002-0. In this case, the cancellation costs are determined by the agreement already concluded with the partner.

(4) Due to the exemption in Section 312g(2) no. 9 of the German Civil Code (BGB), the provisions on withdrawal from contracts concluded away from business premises and distance contracts do not apply to the purchase of admission tickets for leisure events if, as in this case, the contract provides for a specific date or period for performance.

Section 19 Payment by credit card

(1) Two payment methods are offered for orders placed at www.salzbergwerk.de: customers can pay by PayPal or credit card (Mastercard, Visa, Maestro).

(2)   After selecting "credit card" as the payment method, you will be redirected to Unzer’s payment page.

(3)   Credit card payments are made by entering the credit card number, expiry date and, where applicable, CVC number in the corresponding fields of the order dialogue. The payment intermediary involved uses these details exclusively to collect payment and stores them only for this purpose.

Section 20 Payment by PayPal

(1) After selecting "PayPal" as the payment method, you will be redirected to Unzer’s payment page. The PayPal application will open there in a separate window.

(2) You will then be asked to enter your login details, consisting of your email address and password. You may then choose to make the payment by credit card, direct debit or debit from your PayPal account.

(3) To make a payment by credit card or direct debit, you must first have enabled this function in your PayPal account. Further information about the PayPal payment system is available at https://www.paypal.com/de.

Section 21 Data protection/data security

(1) Personal order data is collected, processed and used in accordance with statutory provisions. When payments are made at www.salzbergwerk.de, data is transmitted using 256-bit Secure Socket Layer encryption (SSL). SSL is used worldwide by banks for online banking and meets the highest current security standards on the internet.

(2) As soon as you have entered your data during payment and clicked the confirmation button, your information is transmitted in encrypted form and is therefore protected against external access.

Section 22 Withdrawal by SWS AG

(1) SWS AG is entitled to withdraw from the contract for good cause, in particular if force majeure or other circumstances beyond the control of SWS AG make performance of the contract impossible, for example mining-related technical measures or situations that could compromise guest safety.

(2) In this case, any admission price already paid will be refunded. No liability is accepted for any further loss or damage.

Section 23 Limitation of liability

(1) Irrespective of the legal basis, SWS AG is liable for compensation for loss or damage caused in the course of the contractual relationship only in cases of intent or gross negligence. Unless SWS AG is responsible for an intentional or grossly negligent breach of contract, liability for damages is limited to foreseeable loss or damage typical for this type of contract.

(2) SWS AG is also liable in accordance with statutory provisions if it culpably breaches a material contractual obligation. Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the customer regularly relies and may reasonably rely. In this case, liability for damages is limited to foreseeable loss or damage typical for this type of contract, unless paragraph (1), concerning intent and gross negligence, applies.

(3) The limitations of liability in paragraphs (1) and (2) do not apply where SWS AG is liable for injury to life, limb or health, for damage to privately used property under the German Product Liability Act, or where liability is mandatory by law for any other reason.

(4) Login credentials and passwords issued to a tour operator or partner may be used exclusively by that tour operator or partner and must not be disclosed to third parties. The tour operator or partner is liable for all reservations made using the password assigned to it.

Section 24 Final provisions

(1) Due to the technical characteristics of the internet, the uninterrupted availability of all booking modules at www.salzbergwerk.de cannot be guaranteed.

(2) If individual clauses are or become invalid, this will not affect the validity of the remaining clauses.

(5) German law applies exclusively. Berchtesgaden is the sole place of performance for delivery, services and payment. If both contracting parties are merchants, the courts with jurisdiction for Berchtesgaden, namely Laufen Local Court and Traunstein Regional Court, have exclusive jurisdiction, to the extent permitted by law, over all disputes arising directly or indirectly from the contractual relationship.

 

Right of withdrawal for consumers

The statutory right of withdrawal currently applies only to our product vouchers. There is no right of withdrawal for contracts for the provision of services related to leisure activities if the contract specifies a particular date or period for performance.

Withdrawal information

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, other than the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must inform us (Südwestdeutsche Salzwerke AG / Berchtesgaden Salt Mine, Bergwerkstraße 83, D-83471 Berchtesgaden, telephone: +49 (0)8652/6002-0, info@salzbergwerk.de) of your decision to withdraw from this contract by means of an unequivocal statement, for example a letter sent by post, fax or email. You may use the attached model withdrawal form, but this is not mandatory. You can also exercise your right of withdrawal online using the withdrawal button in the footer of our website. If you use this online function, we will immediately send you confirmation of receipt on a durable medium, for example by email, including information about the content of the withdrawal declaration and the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send the notification that you are exercising your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees as a result of this reimbursement.
